Terms and conditions
America First Coast Travel acts as an introducing agent to our fulfilment partner(s). These General Terms and Conditions apply to the offering and providing of Services by our fulfilment partner(s), who act as a fulfilment agent between the customer and those suppliers offering travel related services.
The General Terms and Conditions can be changed by our fulfilment partner(s) at any time without prior notice, although such changes will not apply to bookings that have already been accepted by our fulfilment partner(s) on behalf of the Supplier(s) concerned. It is therefore essential that the Customer reads, saves and/or prints a copy of the General Terms and Conditions at the time the booking is placed in order to be aware of the provisions in force.
Our fulfilment partner(s) connect customers to travel products to make the necessary reservations, and act as an interface in the transactions involved with the Suppliers. The Customer must be at least 18 years old, be legally authorised to enter into contractual obligations, have the requisite consent or authority to act for or on behalf of any persons included in a booking and must use the our fulfilment partner(s) and America First Coast Travel Website in accordance with these General Terms and Conditions.
The Customer is responsible for their activities on this Website (financially or otherwise), including the possible use of his / her user name and password. The Customer guarantees that the information entered by him / her on the Website in relation to him / her and, if applicable, his / her travelling companions is accurate.
Any use of the America First Coast Travel Website that is fraudulent or is in conflict with these General Terms and Conditions shall be reason for refusing the Customer access to the Services offered by America First Coast Travel, its fulfilment partner(s) and the Suppliers.
Confirmation of a booking, which includes the essential elements such as the description of the Service(s) booked and the price, will be sent to the Customer by e-mail. If the Customer does not receive a confirmation e-mail within 24 hours of placing the booking, please contact Customer Services here.
It is expressly agreed that the data stored in the information systems of our fulfilment partner(s) and / or its Suppliers shall constitute proof with respect to the bookings made by the Customer. Data stored in computers or electronic media are valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.
All such requests will be dealt with on behalf of the Suppliers concerned. The Customer does not have an automatic right of cancellation unless such rights are provided by the individual Suppliers under their Rules and Restrictions (which are provided to the Customer prior to booking).
In the event of cancellation or partial cancellation of a booking by the Customer, charges may be imposed by the applicable Suppliers. Where a cancellation affects more than one person on the booking, any applicable cancellation charge will be applied in respect of each person on the booking. A fee may be imposed by the applicable Supplier in the event of a cancellation or change to a booking. If the Customer does not present himself / herself at the departure of the trip, full cancellation charges will apply unless otherwise stated. We reserve the right to cancel your booking if full payment is not received in accordance with the terms and conditions of the Supplier with whom the booking has been contracted.
Unless otherwise stated by the Customer, it is assumed that the Customer requires the least expensive services. Such services (e.g. economy class) may be provided without any possibility of modification or cancellation. In such cases, the Services cannot be provided in a different manner or at a different time or place to those contracted.
The travel documents provided for a Service ordered through our suppliers our fulfilment partner(s) will be sent to the e-mail address given by the Customer when making his / her reservation.
In relation to ATOL Certificates, the Customer will receive an email including a secure click-through link to their ATOL Certificate shortly after booking payment has been completed. In the unlikely event that the Customer has not received the ATOL Certificate email within 48 hours of completing their booking payment the Customer should contact our fulfilment partner(s) here.
If the delivery of travel documents is impossible because of an error made by the Customer in providing his / her personal details, neither America First Coast Travel, the Supplier nor our fulfilment partner(s) shall be liable.
1. Specific Services
The purpose of this Article is to provide details of the terms and conditions of use of the Services provided by the Suppliers for the Customer’s information. These details are not exhaustive and do not replace the Suppliers’ Rules and Restrictions. In the event of any conflict or inconsistency between the General Terms and Conditions and the Suppliers’ Rules and Restrictions, the Suppliers’ Rules and Restrictions will prevail. The Rules and Restrictions of Suppliers are made available prior to making a booking.
Except in the case of regulatory requirements to the contrary, these details do not give rise to any obligation or liability on the part of our fulfilment partner(s).
1.1 Air Transport Services
Air transport services may be offered separately or as part of a Flight-Plus or package holiday and are subject to the Rules and Restrictions (including conditions of carriage, fare rules and restrictions) of the Supplier. The Rules and Restrictions may include restrictions on and/or charges for cancellation and changes.
Any money paid to an authorised agent (for the purpose of the Air Travel Organisers Licensing Regulations 2012) of our fulfilment partner(s) in respect of a Flight-Plus or a flight-inclusive Package Holiday is held by our fulfilment partner(s) on behalf of, and for the benefit of, the Trustees of the Air Travel Trust at all times.
If our fulfilment partner(s) receive payment on behalf of the Supplier from the Customer for a booking of air transport services, our fulfilment partner(s) act as agent of the Supplier of the relevant air transport services. This means the Customer’s contract for the air transport services is between the Customer and the Supplier of the relevant air transport services.
Prices and fees for some low-cost flights originating outside of the UK may be in another currency. The actual amount charged may vary due to exchange rates or card issuer fees. Neither America First Coast Travel nor our fulfilment partner(s) is liable for such fees.
1.2 Air Transport Terms and Conditions
The Customer is responsible for complying with airline instructions. America First Coast Travel and our fulfilment partner(s) have no control over seat allocation, flight duration estimates, or aircraft changes.
Additional airline charges are outside the control of our fulfilment partner(s).
1.3 Administrative and Health Regulations
The Customer is responsible for ensuring compliance with passport, visa and health requirements. America First Coast Travel and our fulfilment partner(s) accept no liability for refusal of entry or travel due to inadequate documentation.
1.4 Special Fares
Special fares may involve indirect routing or restrictions. Loyalty programmes may not be used when booking through America First Coast Travel and our fulfilment partner(s).
1.5 Liability
Airline liability is governed by applicable international conventions.
1.6 Electronic Ticket
Electronic tickets require valid travel documentation at check-in.
1.7 No Replacement Passengers
Replacement passengers are not permitted.
1.8 Operating Airlines
Flights may be operated by airlines other than the booking carrier.
1.9 Denied Boarding Compensation
Passengers may be entitled to remedies directly from airlines.
2. Accommodation Services
Accommodation may be offered separately or as part of a package holiday or Flight-Plus. The Services are subject to the Rules and Restrictions of the Suppliers.
If reservation changes are not confirmed with our fulfilment partner(s) or the hotel, the reservation may be cancelled in line with Supplier Rules.
Room classifications are indicative and based on local standards.
2.1 Use of Rooms
Rooms are generally available from 14:00 and must be vacated by 12:00.
2.2 Classification
Hotel classifications vary by country.
2.3 Activities
Activities may be cancelled due to circumstances beyond Supplier control.
2.4 Meals
Meal inclusions depend on the accommodation package.
2.5 Taxes
Local taxes may be payable by the Customer.
3. Car Hire
Car hire Services are subject to Supplier Rules. America First Coast Travel and our fulfilment partner(s) accept no liability for local charges, excesses, insurance or Supplier refusal.
4. Destination Services
Destination Services are subject to Supplier Rules and are generally non-refundable.
5. Package Holidays
Package holidays may be provided by Suppliers such as our fulfilment partner(s) and are governed by the Package Travel Regulations.
5.1 Reservations
Acceptance depends on availability.
5.2 Prices
Prices may change subject to regulation.
5.3 Cancellation by the Customer
Supplier cancellation charges may apply.
5.4 Change of Booking
Fees may apply.
5.5 Cancellation and Change by Our Fulfilment Partner(s)
Non-significant changes may be made where permitted by law.
5.6 Price Changes
Prices may be adjusted due to costs or exchange rates.
5.7 Supplier Rules and Restrictions
Services are governed by Supplier Rules.
5.8 Issues During Travel
Issues should be reported promptly.
5.9 Liability
Liability is limited in accordance with applicable law.
6. Flight-Plus Bookings
Where a Flight-Plus exists, our fulfilment partner(s) act as the Flight-Plus Arranger under the Civil Aviation (Air Travel Organisers’ Licensing) Regulations 2012.
In the event of Supplier insolvency, suitable alternatives or refunds will be provided in accordance with ATOL regulations.
7. General
Customers are advised to review official travel advisories prior to booking.
8. Financial Conditions and Payment Procedures
Tax recovery charges relate to amounts paid by our fulfilment partner(s) to accommodation Suppliers.
9. Customer Service and Complaints
Issues should be raised as soon as reasonably practicable with our fulfilment partner(s) or the relevant Supplier.
10. Liability
Where America First Coast Travel and our fulfilment partner(s) act as intermediaries, they are not liable for Supplier performance failures where compensation is available through insurance or applicable conventions.
11. Disclaimer
All information is provided without warranty. America First Coast Travel and our fulfilment partner(s) accept no liability for inaccuracies supplied by third-party Suppliers.
12. Applicable Law
These General Terms and Conditions are governed by the laws of England and Wales.
13. Final Provisions
Failure to enforce any provision does not constitute a waiver. If any provision is found unenforceable, the remaining provisions remain valid.
These General Terms and Conditions come into force on 14 March 2018.
